Electronic signature disclosure and consent
Before you sign a document with TRACE Agree, please read this disclosure. It explains your choices about signing electronically.
United States
Under the federal Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. § 7001 et seq.) and your state’s Uniform Electronic Transactions Act (UETA), you may agree to receive and sign records electronically.
- Paper copy: you can ask the sender for a paper copy of any record at any time, at no charge.
- Withdrawing consent: you can withdraw your consent to sign electronically before you finish signing by choosing “Decline to sign” on the signing page or by contacting the sender. Withdrawing does not affect records you already signed.
- Scope: your consent covers the document you are signing now and the related records the sender delivers with it.
- Keeping your contact details current: tell the sender if your email address changes.
- Hardware and software: a current web browser, an email account, and the ability to open and save PDF files.
Canada
Federally, the Personal Information Protection and Electronic Documents Act (PIPEDA, Parts 1 and 2) governs how personal information is handled and recognizes electronic documents and signatures. Each province and territory has its own electronic commerce law (for example Ontario’s Electronic Commerce Act, 2000 and British Columbia’s Electronic Transactions Act); these generally require that you agree to use electronic documents and allow you to request paper.
Other countries
Many other countries also recognise electronic signatures, for example the European Union (eIDAS Regulation), the United Kingdom (Electronic Communications Act 2000) and Australia (Electronic Transactions Act 1999). Which documents can be signed electronically, and what kind of electronic signature is needed, differs from place to place. TRACE Agree provides an electronic signature confirmed by a one-time email code, with an audit trail. It does not provide “qualified electronic signatures” under eIDAS. The paper-copy and withdrawal choices above apply wherever you are.
Documents that may not be signed electronically
Some documents (for example wills, certain powers of attorney, and documents that must be notarized or witnessed) may need a different signing method depending on where the job is. TRACE Agree does not check this for you. If you are not sure, ask the sender before you sign.
Your consent
When you tick “I have reviewed this document and agree to sign electronically” and sign, we record the consent wording you agreed to, the date and time (with your time zone), and your device’s IP address and browser. They are kept in the document’s audit trail.
